# Cyberdelia PC Diagnostic Tool — Terms of Use & Disclaimer

*Last updated: 9/11/2026

## 1. Acceptance of Terms

By downloading, installing, or running the Cyberdelia PC Diagnostic Tool
("the Software"), you agree to be bound by these Terms of Use. If you do
not agree, do not download, install, or use the Software.

## 2. What This Software Does

The Software reads information from your Windows computer — CPU load,
memory usage, disk space, network status, and running processes — and
displays a report on their condition. **The Software is read-only: it
does not modify, delete, or alter any files, settings, or configuration
on your computer.**

## 3. "As Is" — No Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF
ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NON-INFRINGEMENT. Cyberdelia IT Solutions ("Cyberdelia," "we," "us") does
not warrant that the Software will be error-free, uninterrupted, or that
any diagnostic result or recommendation will be accurate, complete, or
appropriate for your specific system.

## 4. Risk of Use

**You use this Software entirely at your own risk.** In particular:

- **Diagnostic results may be incomplete or wrong.** The Software's
assessment of your system's health is generated automatically and may
miss real problems or flag things that aren't actually a problem.
- **Recommendations are informational, not instructions.** If the
Software suggests an action (for example, freeing disk space), any
changes you choose to make to your own system as a result are made by
you, at your own discretion and risk — the Software does not make
  those changes for you.
- **You are responsible for reviewing any recommendation** and deciding
whether it's appropriate for your situation before acting on it,
ideally with the help of a qualified technician if you're unsure.

## 5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL
CYBERDELIA IT SOLUTIONS, ITS OWNERS, EMPLOYEES, OR CONTRACTORS BE LIABLE
FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE
DAMAGES WHATSOEVER — INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA,
LOSS OF PROFITS, HARDWARE OR SOFTWARE DAMAGE, OR BUSINESS INTERRUPTION —
ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE
SOFTWARE, EVEN IF CYBERDELIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES.

This limitation applies regardless of the legal theory the claim is based
on (contract, tort, negligence, strict liability, or otherwise), and to
the fullest extent such limitation is permitted in your jurisdiction.

## 6. Your Responsibilities

You are responsible for:

- Reviewing diagnostic results and recommendations before acting on them
- Maintaining your own backups of important files and data, as a general
best practice for any software you run
- Ensuring you have the right to run this Software on the computer in question
- Complying with all applicable laws in your use of the Software

## 7. No Professional Advice

The Software's output is provided for general informational purposes and
does not constitute professional IT, technical, or repair advice. For
issues you're not comfortable resolving yourself, contact a qualified
technician — including us.

## 8. Scope

These Terms apply only to the free Cyberdelia PC Diagnostic Tool software
itself. They do not apply to, and do not modify, any separate agreement
covering paid repair, IT support, web design, or other services provided
by Cyberdelia IT Solutions.

## 9. Changes to These Terms

We may update these Terms from time to time, including if the Software's
capabilities change in the future. Continued use of the Software after
changes are posted constitutes acceptance of the revised Terms.

## 10. Governing Law

These Terms are governed by the laws of the State of Florida, without
regard to its conflict-of-law principles, except where applicable law in
your jurisdiction requires otherwise.

*This document is a general-purpose template, not legal advice. Liability
waivers are not enforceable in every circumstance or jurisdiction — have
this reviewed by a licensed attorney in your state before relying on it,
particularly around whether it should be presented as a mandatory
click-to-accept step (stronger legal footing) versus a posted page (weaker).*
